Personal details

Justice Ray Zondo was born at Ixopo, KwaZulu Natal. He is married and he and his wife have been blessed with four children.

Education

He obtained his secondary and high school education at St Mary’s Seminary at Ixopo where he matriculated. He studied law at the University of Zululand, University of Natal (now University of KwaZulu Natal) and later at the University of South Africa. He holds the following degrees:

Professional history

Justice Zondo served part of his articles of clerkship under the late Mrs Victoria Mxenge in the latter’s law firm in Durban. After Mrs Mxenge’s assassination by apartheid agents, Justice Zondo ceded his articles of clerkship to Mthembu & Partners and later to Chennels Alberton Attorneys. After admission as an attorney he became a partner in a Durban law firm, Mathe and Zondo Incorporated, in which he practised for a number of years before he was appointed as a Judge. He also served on a part-time basis as a mediator and arbitrator. In 1991 and 1992 Justice Zondo served in two committees of the Commission of Inquiry Regarding the Prevention of Public Violence and Intimidation (also known as the Goldstone Commission) which investigated violence in South Africa during the early 1990’s.

In 1994 Justice Zondo was appointed as a member of the Ministerial Task Team which was given the task of producing a draft Labour Relations Bill for the post-apartheid South Africa. With certain amendments, that Bill was later passed as the Labour Relations Act, 1995. In 1996 he was appointed as the first chairperson of the Governing Body of the Commission for the Conciliation, Mediation and Arbitration (CCMA) from which position he resigned upon appointment as a Judge With effect from 1 February 1997 Justice Zondo was appointed as an Acting Judge of the Labour Court.With effect from 1 November 1997 he was appointed as a Judge of the Labour Court. In April/May 1999 he was appointed as a Judge of the then Transvaal Provincial Division of the High Court (now the North Gauteng Division of the High Court) in Pretoria.

With effect from 1 August 1999 he was appointed as Acting Judge President of the Labour Appeal Court and Labour Court. With effect from 1 May 2000 he was appointed as Judge President of the Labour Appeal Court and Labour Court for a term of office of ten years. While he was Judge President, Justice Zondo served in various ad hoc committees established by the Heads of Courts. These included a committee, chaired by Chief Justice P.N Langa, which drew up a document to be used by the Judiciary in dealing with complaints about racism and sexism within the Judiciary.

He also served in committees chaired by Judge President Ngoepe which was established by the Heads of Courts to organize the first and second Conferences of Judges in post-apartheid South Africa. Justice Zondo also chaired a committee of the Heads of Courts which looked into the use of official languages in courts.
After completing his term of office as Judge President in 2010, Justice Zondo returned to the North Gauteng Division of the High Court and resumed his duties as a Judge of that court. With effect from 1 November 2011 Justice Zondo was appointed as an Acting Judge of the Constitutional Court until 31 May 2012. On the 13th August 2012 he was appointed as a Judge of the Constitutional Court with effect from the 1st September 2012. On 01 June 2017 Justice Zondo was appointed as Deputy Chief Justice of the Republic of South Africa.

Justice Zondo has published articles and written chapters in three books.

Honours and awards  

In March 2011 Justice Zondo was honoured by the KZN Legal Forum, consisting of many legal bodies, with an award for his contribution to human rights in South Africa

Work Experience 

1 July 2015 to date  

Appointed Executive Director of Fort Hare Solutions, at the University of Fort Hare 

I oversee the institutional administration of Fort Hare Solutions, supervise research and the various  training programmes, as well as facilitate certain training programmes. 

When I joined Fort Hare Solutions the auditors had qualified its financial statements and its relationship with its key stakeholders such as the Eastern Cape Provincial Government was at an all time low. Our financial statements are now unqualified and, on the 23-24 March 2017,  we successfully held a conference whose theme was ‘Effective Partnerships in the implementation of the National Development Plan’, and it was sponsored by the Eastern Cape Provincial Government, the National Planning Commission, the Industrial Development Corporation and the Buffalo City Metro Municipality. We currently deliver training programmes to all municipalities in the Eastern Cape, we have been awarded a contract by the National School of Government to deliver management development programmes to public servants in the Eastern Cape, Free State and KwaZulu-Natal . We also conduct research for the Land Claims Commission focusing on three projects in Limpopo and two in Kwazulu-Natal. 

1 April 2005-to 31 June 2015 

CHIEF OPERATIONS OFFICER- DEPARTMENT OF JUSTICE AND CONSTITUTIONAL DEVELOPMENT 

I was the first Chief Operations Officer for the Department of Justice and Constitutional Development. I established the Office of the COO. I created a new Security and Risk Management Chief Directorate. It provided security to more than 700 courts throughout South Africa, it conducted integrity audits to approximately 22000 public servants in the department, and it also developed the risk management plans of the Department. 

I also created a new Strategic Planning, Monitoring and Evaluation Chief Directorate of the Department. We found the Department having its financial statements qualified by the auditors and its performance management information also qualified. When I left in 2015 the financial statements of the Department, except for the Third Party Fund, was unqualified and the performance information was also unqualified. 

I created a new Post-Truth and Reconciliation Commission Chief Directorate whose mandate was to trace the victims of apartheid declared by the TRC Commission, as well as create relevant  regulations to support these victims. When I left in 2015, the majority of victims were found and paid their compensation, and regulations on basic and higher education as well as health were developed to look after the education and health needs of victims. I had also identified and consulted with 18 communities throughout the country with the purpose of implementing the community rehabilitation recommendations.  

I also created a Programme Support and Administration Chief Directorate whose focus was to develop the service delivery improvement programme, coordinate donor funding and facilitate the resolution of audit findings raised by internal and external auditors. The service delivery improvement programme unit has achieved the development of service delivery models, the mapping of processes, the development of standard operating procedures, the development and approval of Service charter and approval of the service delivery improvement plan. The department was amongst the top five national departments which achieved between 90-100 % in dealing with presidential hotline complaints. A donor coordination policy was developed and approved. Three donor conferences were held. Donor funding was solicited from USAID,European Union ,the Swiss amongst others. The audit facilitation unit contributed in the achievement of no audit qualification for period of three/ four years.

I led the process of creating the new Department of the Chief Justice, and I acted as the Secretary-General in the Office of the Chief Justice until the appointment of the permanent Head. I also acted as the Head of the Justice College, and the CEO of the NPA. 

1 October 2011 to 31 March 2013

Acting Secretary-General in the Office of the Chief Justice

I created new systems for procurement, and transferred staff from the Department of Justice and Constitutional Development and recruited new ones to the new Department of the Chief Justice.  During my tenure  I supported the Chief Justice in his role as Head of the Judiciary by ensuring the Constitutional Court functions efficiently and effectively and relevant structures such as the Heads of Court meetings receive the necessary support. In addition, I also acted as the Accounting Officer and Head of Department in the Office of the Chief Justice.

1 August 2008 to March 2011

Acting Chief Executive Officer 

National Prosecuting Authority of the Republic of South Africa

During this period I ran the administration of the National Prosecuting Authority. It was a difficult period characterized by changes of leadership and political tension. I however managed to stabilize the administration and which led to the acquisition of an unqualified audit the following year.                          

(2000-2005) 

  • Director General and Head of Public Service: Free State Provincial Government: 

I was responsible for running the administration of the Free State Provincial Government, as well as support the Premier to govern the Free State Province. At the time the Provincial Government had about 60 000 public servants. It was a time of tension caused by political factionalism and sensitivities around the transformation of the public service. The administration I led delivered, amongst others, the best matric results at the time,  the best run traffic management division and our health system continued to be one of the best in the country. Working with the Executive Council of the Free State Provincial Government at the time,  I also established the Free State Training and Development Institute.

I was requested to act in the vacant position of the Free State Provincial Government ‘s Director-General by the then Premier of the Free State, the Hon Premier Winkie  Direko, MPL.

  • Deputy Director-General and Head of the Department of Public Works, Roads and Transport  in the Free State Provincial Government  

The Department of Public Works, Roads and Transport won an award from the Arrive Alive Campaign for the manner in which it managed traffic flowing through the Free State Province. We were also able to built social infrastructure such as schools and clinics, and  maintained roads in the Free State.

(2001) 

  • Chairperson of Free State Provincial Government’s Agri-Eco (A GOVERNMENT FUNDED COMPANY)

Agri- Eco was a company established by the Free State Provincial Government. Its mandate was to empower emerging farmers in the Free State. Given the inefficiencies and poor performance of the company the Free State Provincial Government decided to close it down and my mandate was to lead the process of closure and transfer assets and liabilities to the relevant provincial government departments.

  • DIRECTOR in the Office of the Director-General- National Department of Education

My role was to manage projects delegated to me by the Director- General of the National  Department of Education. This included managing the relationship between the Department and teacher professional associations and Trade Unions, as well as leading the department’s Organizational Transformation Task Team to implement change initiatives such as Affirmative Action, Gender Equality and Open Plan Office Space engineering as well as manage relations with Australian consultants appointed by the Australian government to assist to the new South African government with its transformation processes.

Terence Mncedisi Nombembe is the current Chief Executive Officer of the South African Institute of Chartered Accountants (SAICA), a position he occupied since January 2014.In this role he also represents Africa and the Middle East as a Board member of the International Federation of Accountants (IFAC). He also serves as a Board member of the Pan African Federation of Accountants (PAFA).  

His other current and most recent national responsibilities include being:

-    The Panelist of High Level Panel (HLP) that was established by the Speakers Forum to table a report on the impact of legislation in South Africa;

-    The Chairman of the Gauteng Ethics and Anti-Corruption Advisory Council;

-    The Board member of the South African Reserve Bank (SARB), representing Government.

Terence Nombembe served as the Auditor-General (AG) of the Republic of South Africa for a period of seven years (1st December 2006 to 30th November 2013). Prior to the AG role he was the Deputy Auditor-General from 1st June 2000 to 30th November 2006. Altogether he this served in the Auditor-General's office in a leadership role for a total period of thirteen and a half years, (1st June 2000 to 30th November 2013). In this role he also served in the Board of AFROSAI (The African Organisation of Supreme Audit Institutions) as the Vice President and subsequently its President and Chairman. Thereafter he served on the Board of INTOSAI (The International Organisation of Supreme Audit Institutions) as its President and Chairman.

Terence Nombembe studied at the University of Transkei where he completed the Bachelor of Commerce degree, and at the University of South Africa where he completed the Honours in Bachelor of Accounting Science (B.Compt-Honours). He served his articles with Alex Aiken & Carter (now KPMG) in Umtata, and qualified as a Chartered Accountant in 1990. He was conferred with an Honorary Doctorate in Accounting Science by the Walter Sisulu University on the 14th May 2014.


Some of his other previous employers are Gobodo Incorporated, BP Southern Africa (PTY) Limited, Unilever South Africa (Pty) Limited where his experience include external auditing, internal auditing and financial management in the public sector, energy, manufacturing and retail sectors.

Paul Joseph Pretorius joined the bar in 1977 and took silk in 1994.

He attended school in Durban (matriculated as dux). He studied further at the University of Natal. He completed his LLB at UNISA (while banned).

Paul was the President of the Natal University Student’s Representative Council in 1969. He was the Deputy President of the National Union of South African Students (“NUSAS”) in 1970 and President of NUSAS for two terms in 1971 and 1972. Paul was subject to a banning order during the period 1973 to 1977. He was without a passport during the period 1972 to 1986.

Paul spent five years (1981-1986) with the Legal Resources Centre, concentrating on human rights and labour litigation.

Paul has acted as a judge in the High Court (Witwatersrand Local Division) and in the Labour Court on several occasions. He has acted in many cases in the High Court, Labour Court, Labour Appeal Court and the Supreme Court of Appeal, in matters that have been reported. He has also appeared in the Constitutional Court.

Paul has extensive experience in public law (labour law, administrative law, pensions law), contract law, commercial law, mediation and arbitration.

Paul is the editor of Dispute Resolution, published by Juta’s in 1993, now in its 13th reprint. Paul is also the author of occasional papers and articles on labour law, administrative law, pensions law, dispute resolution, mediation and arbitration. He has presented seminars and lectures on the same topics. He has also presented a number of papers in South Africa and overseas on dispute resolution, industrial relations law and human rights.

AREAS OF INTEREST

I have appeared in the Constitutional Court, the Supreme Court of Appeal, in almost all the High Courts in the country, the Broadcasting Complaints Commission, the Labour Courts, the Land Claims Court and the Water Tribunal. I have an interest in Maritime, Administrative and Constitutional Law. I also do a lot of medical negligence cases, cases on administrative law, land claims, commercial and tax matters and also handled cases on constitutional challenges of certain pieces of legislation.
